PREAMBLE
These general terms and conditions of sale are agreed between TrulyForYou, Lda, with registered office at Rua de Timor, 145, 3º Esq. – 2620-065 Olival Basto, Portugal, tax identification number PT517755831 and contact hi@trulyafro.pt, or +351938940046, hereinafter also referred to as “TRULYAFRO”, and persons wishing to make purchases through the website www.trulyafro.pt, hereinafter referred to as “User”.
The parties agree that purchases made through the website www.trulyafro.pt shall be governed exclusively by this contract, excluding any conditions previously available on the website.

ARTICLE 1 - PURPOSE
1 - The purpose of these general terms and conditions of sale is to provide and define all the information necessary for the User regarding the methods of ordering, selling, paying for, and delivering purchases made on the website www.trulyafro.pt.
2 - These terms and conditions govern all the steps necessary for placing an order and ensure that this order is tracked between the Contracting Parties.

ARTICLE 2 - ORDER
1 - The User places their order by completing the purchase process presented at www.trulyafro.pt, adding the product(s) they wish to order to their shopping cart:
To submit their order, the User must:
2 - a) Register on the website www.trulyafro.pt, providing the information requested there.
     b) Fill in the information and choose the options available during the order completion process (delivery and billing address, shipping method, payment method, as well as the VAT number and name you want to appear on the invoice for tax purposes).
3 - Final confirmation of the order by the User implies full and complete acceptance of the prices and description of the products available for sale, as well as these General Terms and Conditions of Sale, which shall be the only ones applicable to the contract thus concluded.
4 - www.trulyafro.pt will honor orders received online only while stocks last. If the product is not available, www.trulyafro.pt undertakes to inform the User as soon as possible.
5 - The data contained in the invoice is the sole responsibility of the User. Once issued, the invoice cannot be reissued with changes.
6 - Orders are valid for seven days, unless the order is registered in a promotional campaign that establishes a different deadline, and prices, discounts, promotions, and offers cannot be guaranteed beyond that period.

7 - If payment is not received by our services within this period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.

ARTICLE 3 - PAYMENT
On the website www.trulyafro.pt, TrulyForYou, Lda offers the User the following payment methods:
  a) via IFTHENPAY Lda - Payment Institution:
      - ATM (Multibanco) Reference;
      - MBWay
  b) Via Shopify Payments - other payment methods.

ARTICLE 4 - DELIVERY
Orders will be delivered within 3 to 10 business days after the order is placed. Delivery is made by CTT - Correios de Portugal.
Shipping costs are added to the order. Delivery rates vary depending on your location. TRULYAFRO applies fixed rates based on the regions described below:

Portugal and Spain:
Free delivery; delivery expected within 3 to 5 business days.

Europe:
Delivery fee of €9.95; delivery expected within 3 to 5 business days.

North America:
€16.30 delivery fee; delivery expected in 5 to 10 business days.

Rest of the world:
€13.70 delivery fee; delivery expected in 5 to 10 business days.

As described above, deliveries can take 3 to 10 business days, depending on the address provided during purchase, due to general shipping/delivery services.
By default, deliveries are quite simple and arrive in less than a week. However, please consider the above-mentioned timeframe if it takes longer.
Also, don't hesitate to contact us if, for any reason, you do not receive your purchase within the expected time frame, as we will ensure its delivery.

ARTICLE 5 - PRICES
Prices are in euros and include VAT (calculated at the rate in effect on the date of the order).

EXTRA TAX COST FOR BUYERS OUTSIDE THE EU:

Outside the EU, you may have to pay import taxes at your own expense, charged by local customs.

Trulyafro.com only pays delivery costs when the standard free shipping option applies, which means that import taxes are not included in the free shipping option. As any additional tax costs are not under the control of www.trulyafro.pt, being strictly a local government process and regulation, we strongly recommend that all TRULYAFRO customers check with their local customs office in advance for the exact amount of additional tax costs.

ARTICLE 6 - CANCELLATION AND RETURNS/REFUNDS // EXCHANGES

  1. The cancellation or return process is handled on a case-by-case basis by TRULYAFRO. The request must be sent in writing to the contact email address hi@trulyafro.pt within 14 days of placing the order, and instructions for canceling or returning the products will be sent by TRULYAFRO via the same means of communication.
  2. TRULYAFRO accepts any exchange or return provided that: 
  • The User informs TRULYAFRO of their decision to exchange or return the goods within 14 days of receiving the order;
  • The item to be returned or exchanged arrives at the seller within 14 days of notification of the decision to exchange or return it; The item to be exchanged is still in stock.
  • If the product to be exchanged is not in stock, the customer may choose another product on our website, within the price range of the product previously purchased and to be exchanged.
  • Extra costs may be charged if the chosen product is above the price range of the product to be exchanged, and we will refund the customer if the chosen product is lower than the product to be exchanged. 
  • The item to be exchanged or returned is in exactly the same condition as when the buyer received it (i.e., in its original packaging, with its labels, undamaged, with no signs of use, smell, or washing);
  • If any of the above problems occur, as well as any other problems that demonstrate that the returned product is not in its original condition and as delivered, TRULYAFRO reserves the right to retain the total amount paid for the product as compensation;
    In addition, where applicable, all refunds will be made using the same payment method used for your purchase. If the return is accepted, TRULYAFRO undertakes to refund the User within a maximum of 8 days after receipt of the returned product.

    Note: Return shipping costs are borne by the consumer.

     

    ARTICLE 7 - PRIVACY POLICY

    Your data is processed in accordance with personal data protection legislation. This data, which is subject to computer processing, will be included in TRULYAFRO's database(s) and is intended for the registration and presentation of other products and services, as well as for institutional information to be made available by TRULYAFRO.

    Their provision is optional and you are guaranteed, under the terms of the law, the right to access, rectify and cancel any data that directly concerns you, in person or in writing, directly to the address on the home page of this website.
